THE Bloemfontein High Court's removal of the Estina Vrede Dairy case from the roll is unjust for beneficiaries.
The DA has expressed dismay following the recent decision to strike incidents like this.
The party said this contributes to the public's loss of confidence in the criminal justice system's ability to fight against corruption and other crimes.
"This decision marks a significant setback in the quest for justice for both the people of the Free State and the beneficiaries who are affected by corruption and state capture," said DA Free State leader Roy Jankielsohn.
He emphasised that the Estina project scandal had devastating consequences for the beneficiaries and the community, with hope but were ultimately disappointed.
Jankielsohn said despite yesterday's ruling (7 August), the DA remains unwavering in our commitment to hold those responsible accountable.
"We will continue to pursue every available avenue to ensure that justice is served and that the affected communities receive the redress they rightfully deserve."
The judge cited delays in the matter for her decision.

R342 million was set aside over three years for the project.
It's alleged that R24,9 million was paid to Nulane Investment for a feasibility study between November 2011 and April 2012.
The company is owned and controlled by the Gupta associate Igbal Sharma.
The spokesman for the National Prosecuting Authority, Mthunzi Mhaga, assured that the case would be reopened promptly.
He stated that the state is fully prepared to proceed, with witnesses ready to testify in court.
Mhaga said on 15 June, the defence was provided with electronic versions of the same hard copies disclosed in early 2023.
"The state also made its own technical expert available to assist the defence in accessing the digital platform, should they experience any challenges," said Mhaga.
Jankielsohn vowed that the fight for accountability and transparency was far from over, and the DA remains resolute in its determination to see this matter through to its rightful conclusion.
"We hope that the reinstatement of this case will have a better outcome the third time around," he said.
